SHIPPING & DELIVERY POLICY

This Shipping & Delivery Policy applies to Goods supplied by Shamber Pty Ltd ABN 87 169 618 660 trading as MobiGo Distributors (MobiGo, we, us or our). MobiGo primarily supplies wholesale and business customers throughout Australia.
This Policy should be read together with MobiGo's Terms & Conditions of Trade and Returns & Refunds Policy. Nothing in this Policy excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under applicable Australian law.
1. Delivery Areas
MobiGo delivers to business and other approved delivery addresses throughout Australia, subject to carrier coverage, product restrictions and freight availability.
Some remote, regional or restricted locations may require additional delivery time, special freight arrangements or additional charges. If we cannot reasonably deliver an Order to the nominated location, we will contact the Customer to discuss available options.
2. Processing and Dispatch
MobiGo aims to process and dispatch Orders as promptly as reasonably practicable after the Order has been accepted and any required payment or account approval has been completed.
Dispatch timing may vary depending on stock availability, Order size, pallet or bulky-freight requirements, payment clearance, warehouse workload, public holidays and carrier collection schedules.
Any dispatch timeframe displayed on our website or communicated by MobiGo is an estimate unless we expressly agree in writing that a particular dispatch date is guaranteed.
3. Delivery Timeframes
Delivery timeframes are estimates only unless MobiGo expressly guarantees a delivery date in writing. Actual delivery times vary according to destination, carrier, freight service, Order size and circumstances outside MobiGo's reasonable control.
Customers should allow additional time for regional and remote destinations, pallet freight, unusually large Orders, peak trading periods and public holidays.
Where applicable law gives a Customer rights because Goods are not supplied within an agreed or reasonable time, nothing in this Policy limits those rights.
4. Freight and Delivery Charges
Unless MobiGo agrees otherwise in writing, freight, delivery, handling and applicable transport charges are payable by the Customer.
Freight may be calculated according to factors including destination, weight, dimensions, number of cartons or pallets, freight service and any special handling requirements.
Any free-freight offer or negotiated freight arrangement may be subject to minimum Order values, delivery areas, product exclusions, pallet quantities or other conditions notified by MobiGo.
Additional freight charges may apply where the information provided at the time of ordering was incomplete or incorrect or where the delivery requirements materially change after the Order is accepted.
5. Delivery Address and Customer Information
The Customer is responsible for providing a complete, accurate and accessible delivery address together with any relevant business name, contact person, telephone number and delivery instructions.
Customers should check delivery details before submitting an Order and notify MobiGo promptly if a correction is required.
MobiGo is not responsible for additional costs or delays caused by incorrect, incomplete or outdated delivery information supplied by the Customer, except to the extent liability cannot lawfully be excluded.
6. Business and Commercial Deliveries
The Customer must ensure that the nominated delivery location can reasonably receive the type and quantity of Goods ordered.
For pallet, bulky or commercial freight, the Customer may be required to provide suitable access and appropriate unloading facilities or personnel. The Customer should notify MobiGo before dispatch if the delivery location has restrictions affecting trucks, pallets, forklifts, tailgate access, loading docks or delivery hours.
Additional carrier charges arising from special delivery requirements may be passed on to the Customer where disclosed or reasonably incurred and permitted by law.
7. Authority to Leave
Where the Customer gives authority for Goods to be left unattended, the carrier may leave the Goods in a location it considers suitable and safe in accordance with the applicable carrier service.
Once Goods have been properly delivered in accordance with the Customer's authority to leave, the Customer accepts the risk of theft, loss or damage occurring after delivery, except where liability cannot lawfully be excluded.
An authority-to-leave request does not guarantee that a carrier will leave a consignment unattended. A carrier may decline to do so where there is no suitable safe location, the service requires a signature, the Goods are unsuitable for unattended delivery or the carrier's rules do not permit it.
8. Signature on Delivery
Some Orders, products, destinations or freight services may require a signature on delivery.
Where a signature is required, the Customer must ensure an authorised person is available to receive the Goods. If nobody is available, the carrier may arrange collection, redelivery or another delivery process in accordance with its terms and additional charges may apply.
9. Failed Delivery and Redelivery
If delivery cannot be completed because the Customer is unavailable, the premises are closed or inaccessible, the address is incorrect, unloading cannot reasonably occur, or another Customer-related issue prevents delivery, the carrier may return, hold or arrange redelivery of the Goods.
The Customer may be responsible for reasonable redelivery, storage, return-to-sender or additional freight charges arising from a failed delivery where the failure was caused by circumstances within the Customer's control.
10. Customer Collection
Where MobiGo agrees that an Order may be collected from its warehouse or another nominated location, the Customer must wait until MobiGo confirms that the Order is ready for collection.
The person collecting may be required to provide the Order or invoice number and reasonable identification or authority to collect.
Risk in Goods collected by the Customer generally passes when the Goods are handed to the Customer or its authorised representative, subject to MobiGo's Terms & Conditions of Trade and applicable law.
11. Customer-Arranged Freight
Where the Customer nominates or arranges its own carrier, the Customer is responsible for the carrier arrangement and applicable freight charges unless otherwise agreed.
Risk generally passes when the Goods are collected from MobiGo by the Customer's nominated carrier. Claims concerning loss or damage occurring after collection should generally be made with the nominated carrier, subject to applicable law and MobiGo's contractual obligations.
12. Split Shipments and Backorders
MobiGo may, where reasonable, dispatch an Order in more than one shipment where products are stored separately, some Goods are temporarily unavailable or different freight methods are required.
Where an item is backordered, MobiGo may hold the Order, dispatch available Goods separately, offer an alternative product, provide an estimated availability date or cancel and credit/refund the unavailable item as appropriate.
Where an additional freight charge would arise solely because MobiGo elects to split an Order, MobiGo will not impose that additional charge without the Customer's agreement unless otherwise permitted by the applicable trading arrangement.
13. Tracking
Where tracking is available, MobiGo may provide tracking information by email, through the Customer's online account or by another method.
Tracking events and estimated delivery dates are generally provided by the carrier and may change during transit. Customers should contact MobiGo if tracking indicates an unusual delay or delivery issue that requires investigation.
14. Delayed or Lost Deliveries
If an Order has not arrived within the estimated delivery period, please contact MobiGo with the Order or invoice number so that we can investigate with the carrier.
Delivery delays may occur because of weather, transport disruption, carrier network issues, industrial action, natural disasters, peak demand, road closures, supplier delays or other circumstances outside MobiGo's reasonable control.
Where Goods are confirmed lost in transit before risk has passed to the Customer, MobiGo will provide an appropriate solution, which may include replacement, account credit or refund, subject to applicable law and the circumstances of the Order.
15. Damaged Deliveries, Shortages and Incorrect Goods
Customers should inspect Goods promptly after delivery.
Visible freight damage, shortages or incorrect Goods should be reported to MobiGo as soon as reasonably practicable and preferably within 48 hours of delivery. This timeframe assists us in investigating the issue with the warehouse or carrier and does not remove rights that cannot lawfully be excluded.
Please retain the Goods and packaging and provide photographs, the invoice or Order number, affected quantities and other reasonable information requested for the investigation.
Claims will be handled in accordance with MobiGo's Returns & Refunds Policy and applicable law.
16. Transfer of Risk and Retention of Title
Risk in Goods passes in accordance with MobiGo's Terms & Conditions of Trade. Generally, risk passes on delivery to the Customer's nominated location or, where the Customer collects or arranges its own carrier, on collection.
Passing of risk does not necessarily mean legal ownership of unpaid Goods has passed. Retention-of-title and PPSA provisions in MobiGo's Terms & Conditions of Trade continue to apply where relevant.
17. Force Majeure and Events Beyond Our Control
MobiGo will not be responsible for a failure or delay in delivery caused by circumstances beyond its reasonable control, except to the extent liability cannot lawfully be excluded.
Such circumstances may include severe weather, flood, fire, natural disaster, war, government action, industrial disputes, transport disruption, carrier failure, telecommunications outages, supplier shortages, import delays or major logistics interruptions.
MobiGo will use reasonable efforts to communicate material delays and resume normal supply as soon as reasonably practicable.
