This Privacy Policy explains how Shamber Pty Ltd ABN 87 169 618 660 trading as MobiGo Distributors (MobiGo, we, us or our) collects, holds, uses and discloses personal information in connection with our wholesale distribution business, website, trade accounts, orders, deliveries and credit applications. 

We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) where they apply to us, together with other applicable Australian privacy, spam and communications laws. 

1. Personal Information We May Collect 

The kinds of personal information we may collect and hold depend on how you deal with us. They may include: 

  • Name, job title and business role; 

  • business name, ABN, ACN and business structure; 

  • business, postal and delivery addresses; 

  • telephone numbers and email addresses; 

  • account usernames and customer account information; 

  • order, invoice, payment and transaction information; 

  • delivery instructions and records; 

  • communications, enquiries, complaints and customer-service records; 

  • marketing preferences; 

  • information supplied in a trade or credit account application, including director, proprietor, partner, trustee or guarantor details; 

  • trade-reference information and information obtained during reasonable credit assessment activities; and 

  • technical information associated with the use of our website, such as IP addresses, browser/device information, cookies and similar usage data, was collected. 

We generally do not need sensitive information for ordinary wholesale transactions and ask that you do not provide sensitive information unless it is reasonably necessary, and we are permitted to collect it. 

2. How We Collect Personal Information 

We usually collect personal information directly from you or from an authorized representative of your business. This may occur when you: 

  • apply for a trade or credit account; 

  • create or use an online account; 

  • place an Order or request a quotation; 

  • contact our sales, accounts or customer-service teams; 

  • communicate with a MobiGo representative; 

  • complete a form or provide a personal guarantee; 

  • request delivery, return or warranty assistance; or 

  • use our website or interact with our electronic communications. 

Where appropriate and permitted by law, we may also collect information from trade references, credit reporting bodies or credit information providers, publicly available sources, payment providers, delivery and logistics providers, fraud-prevention services or other parties involved in administering your business relationship with us. 

3. Why We Collect, Hold, Use and Disclose Information 

We may collect, hold, use and disclose personal information for purposes connected with operating MobiGo, including to: 

  • establish and administer trade and online customer accounts; 

  • process Orders, payments, invoices, credits, returns and refunds; 

  • provide quotations and customer-specific pricing; 

  • arrange freight and delivery; 

  • communicate about Orders, products, accounts and customer service; 

  • assess, approve, administer, review or recover commercial credit; 

  • verify information supplied in a credit application and contact trade references; 

  • manage overdue accounts and enforce lawful contractual rights; 

  • detect or prevent fraud, misuse or unauthorised account activity; 

  • maintain and improve our website, systems, products and services; 

  • send business or marketing communications where permitted by law and manage opt-out requests; 

  • meet legal, regulatory, accounting, insurance and record-keeping obligations; and 

  • protect MobiGo, our customers and others from unlawful or harmful activity. 

4. Credit Applications and Credit-Related Information 

Where a business applies for commercial credit, MobiGo may collect personal information about directors, proprietors, partners, trustees, guarantors and trade-reference contacts for the purpose of assessing and administering the application and any approved Credit Account. 

For commercial credit applications, we may use personal information to assess the application, verify information, administer an approved account, and recover overdue amounts that were permitted by law. Commercial credit information is generally handled under the APPs where they apply. 

Consumer credit reporting information is subject to additional requirements under Part IIIA of the Privacy Act and the applicable Privacy (Credit Reporting) Code. If MobiGo handles consumer credit reporting information in circumstances that trigger those requirements, we will provide any additional notices, consents, and credit reporting policy required by law. 

5. Disclosure to Service Providers and Other Parties 

We may disclose personal information where reasonably necessary to parties that assist us to operate our business, including: 

  • couriers, freight companies, warehouses and logistics providers; 

  • payment processors, banks and financial service providers; 

  • IT, hosting, software, cloud, website and cybersecurity providers; 

  • accountants, auditors, insurers, lawyers and other professional advisers; 

  • debt collection and credit assessment providers where appropriate; 

  • suppliers or manufacturers where necessary to resolve an Order, warranty or product issue; 

  • government, regulatory, law-enforcement or judicial bodies where required or authorised by law; and 

  • other parties where you have authorised the disclosure or where disclosure is otherwise permitted by law. 

We do not sell personal information to third parties. 

6. Overseas Disclosure 

MobiGo may use technology, cloud, software, payment, communications and other service providers that operate or store information outside Australia. Whether this involves a disclosure of personal information to an overseas recipient depends on the particular arrangement. 

Where MobiGo is likely to disclose personal information to an overseas recipient, we will identify the countries in which those recipients are likely to be located where it is practicable to do so. Before making a cross-border disclosure, we will take reasonable steps required by Australian privacy law in relation to the overseas recipient, unless an exception applies. 

Our service-provider arrangements may change. You may contact us using the details in section 15 for current information about likely overseas disclosures and the countries involved, where practicable. 

7. Website, Cookies and Analytics 

Our website may use cookies and similar technologies to support website functionality, remember preferences, maintain account sessions, understand website usage, improve performance and help protect against fraud or misuse. 

You can usually control cookies through your browser settings. Disabling some cookies may affect the operation of certain website features. 

Where third-party analytics, advertising, cookies, pixels or similar technologies involve personal information, we will handle that information in accordance with applicable privacy law. Where consent or another legal requirement applies to a particular technology or communication, we will take appropriate steps to comply. 

8. Direct Marketing 

Where permitted by law, MobiGo may use personal information to send information about products, promotions, account services or other business offers. Electronic commercial messages will be sent in accordance with applicable requirements, including the Spam Act 2003 (Cth). 

You may opt out of marketing communications at any time using the unsubscribe facility provided, where applicable, or by contacting us. We will action opt-out requests as required by law. Where required under the APPs, we will also provide a simple means to opt out and, on request, provide the source of personal information used for direct marketing unless it is impracticable or unreasonable to do so. We may still send non-marketing communications necessary for Orders, accounts, invoices, deliveries, legal notices or customer service. 

9. How We Hold and Protect Personal Information 

MobiGo may hold personal information electronically and, where necessary, in physical records. Information may be stored in business systems operated by us or by contracted service providers. 

We take reasonable steps appropriate to our operations to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Measures may include access controls, account permissions, security practices, staff procedures, backups and use of reputable service providers. 

No method of electronic storage or transmission is completely secure. Where information is no longer required and we are not legally required to retain it, we will take reasonable steps to destroy or de-identify it. 

10. Access and Correction 

You may request access to personal information that MobiGo holds about you and may ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. 

To make a request, contact us using the details in section 15 and provide enough information for us to identify you and the relevant records. We may need to verify your identity before providing access or making a correction. 

We will respond within a reasonable period. In some circumstances, Australian law permits or requires us to refuse access or correction. If that occurs, we will provide an explanation where required. 

11. Anonymity and Pseudonyms 

Where lawful and practicable, you may deal with us without identifying yourself or by using a pseudonym. However, identification will generally be required where we need to establish a trade account, process and deliver an Order, issue an invoice, assess commercial credit, provide account support or comply with legal requirements. 

12. Privacy Complaints 

If you believe MobiGo has mishandled your personal information or breached an applicable privacy requirement, please contact us using the details in section 15. 

Please provide sufficient details about the issue so that we can investigate it. We will acknowledge and investigate privacy complaints and respond within a reasonable period. 

If you are not satisfied with our response, or we have not responded within a reasonable period, you may be able to complain to the Office of the Australian Information Commissioner (OAIC). The OAIC generally expects you to raise the matter with the organisation first and allow it an opportunity to respond. 

13. Automated Decisions 

From 10 December 2026, additional APP 1 privacy-policy requirements apply where an organisation has arranged for a computer program to use personal information to make a decision, or do a thing substantially and directly related to making a decision, that could reasonably be expected to significantly affect an individual's rights or interests. If MobiGo uses personal information in this way, this Privacy Policy will identify the kinds of personal information used and the kinds of significant decisions involved, as required by law. 

14. Changes to This Privacy Policy 

We may update this Privacy Policy from time to time to reflect changes to our business, systems, service providers, legal obligations or information-handling practices. 

The current version will be published on the MobiGo Distributors website with its effective or last-updated date. We encourage you to review it periodically.
